HAWAII POLICE DEPARTMENT -- COMPENSATORY TIME

GENERAL ORDER NO.

                                                                                                                                       532

I.   PURPOSE

     A.   To establish a uniform procedure by which to accrue and grant compensatory time off (CTO).

II.  GENERAL PROVISIONS

     A.   An Employee who has performed overtime work shall receive cash payment or CTO as provided in the
          respective collective bargaining agreements.  

     B.   If a cash payment for overtime work is to be made, it shall be made within the pay period following the
          performance of overtime work, or as soon as practicable, but in no event shall payment be made beyond the
          next payday after the computation of the overtime work can be made at the rate of one and one-half (1 ½)
          hours for each hour worked.  

     C.   An Employee earns CTO in lieu of cash at the rate of one and one-half (1½) hours for each overtime hour worked. 

III.  DEFINITIONS

     A.   "Reasonable Period" means ninety (90) days.

     B.   "Unduly disruptive" means imposing an unreasonable burden on the Department’s ability to provide services
           of acceptable quality and quantity for the public during the time requested without the use of the requesting
           Employee’s service.  

     C.   "Department" means the Hawaii Police Department.

     D.   "Employee" means all nonexempt employees of the Hawaii Police Department.

     E.   "Supervisor" means any officer having supervisory responsibilities.

IV.  ACCUMULATION OF COMPENSATORY TIME

     A.   Accumulation of compensatory time -- Employees who are members of Bargaining Unit 12 may accumulate a maximum of
          one hundred (100) hours of compensatory time credit.  The Department may unilaterally schedule such hours in
          excess of one hundred (100) hours off or shall pay the Employee in cash.

     B.   For all other Employees, limits on accumulated hours shall be governed by existing Collective Bargaining
          Agreements.

V.   REQUEST TO USE COMPENSATORY TIME OFF

     A.   The Department shall grant CTO in compliance with existing collective bargaining agreements and Federal and
          State Labor law requirements. 

     B.   Employees shall submit requests for CTO to their respective supervisor utilizing the CTO/Shift Change Request
          Form HPD/PAT -- 002 no less than five (5) days prior to the requested date.  Requests will be considered in the
          order in which they were received.

     C.   A request for CTO shall be granted unless granting the request would be Unduly Disruptive to the section or
          division’s operations. 

     D.   If a request by an Employee for CTO cannot be granted for the time and date requested, the supervisor shall
          provide the Employee an alternate date within a Reasonable Period of the original date requested.

     E.   Supervisors approving requests for CTO shall be responsible for verifying that the Employee has sufficient
          compensatory time credits available.
