Big Island police have charged a 24 year-old Puna man in connection with the death of Sarah M. Fay, his 34 year-old female companion. Marwann Timothy Saad Jackson was charged this afternoon (November 30, 2005) with second degree murder, 2nd degree murder by omission, kidnapping, first degree sexual assault, 2nd degree robbery and violation of an order for protection. He is being held without bail at the Hawaii Community Correctional Center.
The two murder offenses listed refer to a single incident with the single victim. The crime is charged in this manner to make it clearer for the jury at the time of trial, their options when considering the guilt or innocence of the accused. While the victim has been declared dead as a matter of law, she remains on life support at the Queen’s Medical Center on Oahu.
On November 25, 2005, at about 1:04 p.m., Puna patrol officers responded to a call of an unconscious female at a residence in the Fern Acres Subdivision in Puna. Upon their arrival, they located the 34 year-old victim who was being treated by Hawaii Fire Department Rescue Personnel.
The victim was transported to the Hilo Medical Center and was later transferred to the Queen’s Medical Center.
Police were able to determine that the 24 year-old male suspect fled the scene prior to officers arrival in an early model four door sedan at which time an All Points Bulletin was issued to officers, who stopped the vehicle in the upper Ainaloa Subdivision and arrested the driver for several arrest warrants for unrelated offenses. On November 28, 2005 at 3:25 p.m., police reclassified the initial assault investigation and arrested Jackson for second degree attempted murder.
